Our goal is to ensure a sound commercial outcome for our clients. However,if your matter needs to proceed towards trial our firm is one of the most experienced in running estate related disputes to trial. We have had significant success in areas such as Family Provision, challenging or proving the validity of wills, promises relating to land prior to death and superannuation issues.
Our results-oriented approach attracts talented legal practitioners, enabling a unique capability to achieve excellent outcomes in large or complex estate disputes while understanding the unique and difficult circumstances which our clients often face.
Eastwood Law has experience in acting in a range of jurisdictions in estate matters and related disputes, including the Supreme Court of Western Australia, the Court of Appeal (WA), the High Court of Australia and the State Administrative Tribunal.
We have advised and acted for clients based in other states of Australia as well as overseas.
When a will maker dies, the executor generally has a duty to obtain a grant of probate before carrying out the terms of the will. Where a person dies without leaving a will, a grant of letters of administration will be required before the estate can be distributed.
MoreIf you have a concern that your parent or loved one did not have the ability to make a will, or signed a will that did not reflect their true intentions, you may be able to make an application to challenge the validity of the will. In many cases, if successful, such a challenging will result in the Court granting probate over a previous will.
MoreBeing an executor is a significant responsibility. Executors often need assistance in knowing how to carry out the terms of a will and properly administer an estate.
MoreAs a beneficiary under a will, you are entitled to ensure that you have received what is due to you. We are experienced in advising beneficiaries as to their rights in keeping executors accountable in their management of the assets of a deceased estate. This often involves requesting that an executor “pass accounts” to prove to the Court that beneficiaries are receiving their full entitlement.
MoreTrusts are frequently used in estate planning, and family and farming businesses. The question of what your rights are as a beneficiary can often seem confusing or too difficult to address.
MoreThere are some estate disputes which involve more than one of the areas mentioned above. In the case of complex estate disputes, our experience helps us to ask the right questions and to develop an effective approach to a commercial solution. At Eastwood Law, we have managed cases which involve a combination of claims involving the validity of a will, constructive trust claims, and family provision claims.
