Elder Law

As people live longer, they are increasingly vulnerable to undue influence when making a will, executing an Enduring Power of Attorney (EPA), Enduring Power of Guardianship (EPG) or undertaking transactions such as transferring property. This vulnerability is magnified in cases where the elderly person is dependant upon others, is emotionally fragile or experiencing cognitive impairments or health issues.

We assist with:

  • undue influence and elder abuse complaints;
  • advice regarding legal capacity;
  • guardianship applications;
  • disputes over appointments under EPAs and EPGs
  • advice regarding Advanced Health Directives.

Our Approach

We focus on trial readiness and the identification of critical issues early on to maximise the prospects of turning opportunity into advantage and resolving will disputes & family provision claims quickly and cost effectively.
